Ordinary Power of Attorney
An Ordinary Power of Attorney is usually created for a set period of time, eg three months, where the Donor is going abroad, or is unable to act for some other reason. It provides for the person appointed to have the authority to act on their behalf, and the authority granted can be a General Power, or limited to a specific requirement.
An Ordinary Power of Attorney will usually end at the end of a specified time. It will be automatically revoked if the Donor loses mental capacity.
There is no requirement for an Ordinary Power of Attorney to be registered with the Office of the Public Guardian.
This type of Power of Attorney is commonly used for clients of Decimus Fearon in property transactions where the client wishes to appoint a Partner of the firm to deal with a transaction whilst the Donor is abroad, or uncontactable for some reason. The Power of Attorney will enable Decimus Fearon to sign documents on behalf of their client, ensuring that the transaction proceeds in the absence of the Donor.
